BLOCKCHAIN LAB BRIEFING · REGULATION

The CFTC Says Staff Updated Its FAQs on Crypto and Blockchain Activities

A staff FAQ is not a statute, but it is the document firms actually read when they ask what they are allowed to touch. The post is the agency. The FAQ text is one click further than this page went.

01

What happened

On 24 September 2026 @CFTC posted that staff had released updates to its FAQs on registrant and registered-entity activities relating to crypto assets and blockchain technologies. The post links a press release numbered 9303-26. This snapshot shows 360 reposts, 61 quotes, 44 replies and 1,340 likes.

A FAQ tells you how staff currently reads obligations. It does not amend the Commodity Exchange Act, and the post does not summarise what changed.

02

Why it matters

Registered intermediaries have been waiting on whether listing, clearing, custody-adjacent services and tokenised collateral are inside existing duties. An update is news only once the delta is known. The post announces the document and stops.

Do not describe a staff FAQ as the Commission voting a new crypto regime. The account says staff released an update.

03

The operating layer

Compliance should open release 9303-26 and mark what is new against the previous FAQ. This page has not done that marking.

If a vendor says 'the CFTC now allows X' because of this post, ask them to point at the answer number.

04

What is verified

The agency's own account announced a staff FAQ update and gave the release number.

The contents of the FAQ were not extracted here.

05

What is still unclear

Which answers changed.

Whether any answer addresses tokenised collateral, prediction markets, or custody.

The effective practical date, which for a FAQ is usually immediate and still not a rulemaking.

06

The catch

An official post can still be a pointer. The pointer is real. The permission people will claim from it is not, until the answer they mean is quoted.

WATCH

What builders should watch

  1. 01Press release 9303-26.
  2. 02A diff against the previous FAQ.
  3. 03Any answer a firm wants to rely on, quoted.
  4. 04That staff FAQs are not Commission orders.

BOTTOM LINE

The CFTC says staff updated the FAQs that tell registrants how crypto and blockchain activity sits inside existing duties. That is a real document, numbered 9303-26. This page has not read the answers, and a FAQ is not a new statute.
