A Post Says Democrats Moved the Goalposts on the CLARITY Act After Getting Three Concessions

The three concessions, if they are really in a draft, are the bill. The argument about who moved the goalposts is politics. The circuit breaker is the operating clause.

What happened

On 14 September 2026 @Scaramucci posted that Patrick Witt had given Democrats most of what they asked for on the CLARITY Act: an ethics provision empowering state attorneys general, watered-down DeFi protections, and a circuit breaker on stablecoin yield and bank deposit flight. He says Democrats are moving the goalposts again, and he names Senator Lummis and Witt. This snapshot shows 146 reposts, 15 quotes, 111 replies and 1,287 likes.

The post does not quote the draft. A separate post the same day, from @scottmelker, said a new draft would give Treasury a circuit-breaker to stop payment-stablecoin deposit flight from community banks, to be offered if cloture were invoked on 15 September. The two posts describe a similar device and are not the same document.

Why it matters

A circuit breaker on yield is the clause a stablecoin issuer and a bank both understand. It is a switch that stops a feature when deposits move. Who holds the switch, Treasury or someone else, is the whole design, and these posts do not agree on the actor because they are not quoting one text.

State attorneys general in an ethics provision is an enforcement design. 'Watered down DeFi protections' is an opinion about a draft this desk has not read.

The operating layer

Do not implement a product against a thread's summary of a bill. If a yield feature exists, the question is whether a statute can turn it off, and who can throw that switch.

A goalposts argument is not a section number.

Scaramucci's post lists three concessions and a political judgement.

The bill text is not in the post. The cloture date in the other post is that post's claim.

What is still unclear

Whether any of the three items is in the draft that was actually circulating on 14 September.

Who can pull the circuit breaker.

Whether 15 September cloture happened. This page does not say.

The catch

Summarising a live bill from two posts will invent a statute. The only safe sentence is that participants were arguing, in public, about yield, deposits and who can stop them.

BOTTOM LINE

The post says a CLARITY draft traded away DeFi language and added a switch on stablecoin yield and deposit flight. That switch is the part a product would have to obey. The post is not the draft, and a second post names Treasury as the hand on a similar switch.
